North American Vasa, Inc. Festival of Races 2027
Release and Waiver Agreement
In consideration of myself and/or my minor child being permitted to participate in the North American Vasa, Inc. (hereinafter, “NAV”) “Festival of Races” during the weekend of February 13 and 14, 2027 at Timber Ridge Resort, Traverse City, MI, I hereby represent, on behalf of myself and/or my minor child, as follows:
1. I fully understand that the Festival of Races includes Nordic ski racing and touring and fat tire bicycling (hereinafter, “activities”), that these activities can be inherently dangerous and strenuous, and that I/we are in good health and adequate physical condition to be able to safely participate in these activities;
2. I fully understand that these activities involve risks and dangers of serious bodily injury and that these risks and dangers may be caused by my/our own negligence or the negligence of other participants, conditions inherent in cold weather activities generally, conditions relating to the ski, bike or snowshoe trail, or defects in the equipment I/we use during these activities. Furthermore, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 while participating in NAV activities and that such exposure or infection may result in personal injury, illness, permanent disability and death. I understand that the risk of becoming exposed to or infected by COVID-19 during the Festival of races may result from the actions, omissions, or negligence of myself and others, including, but not limited to, NAV volunteers, observers and other NAV participants and their families, as well as Timber Ridge employees.
3. I hereby release, discharge, hold harmless and covenant not to sue NAV, its directors, agents, officers, members, volunteers, independent contractors and employees, any sponsors, advertisers, as well as the owners and lessors of the property on which these activities take place, including the Timber Ridge Resort, from all liability, claims, demands, losses, or damages on my account, or that of my minor child, caused or alleged to be caused in whole or in part by the negligence of any of the individuals or entities named herein.
I fully accept and assume all such risks and all responsibility for such losses or damages I/we may incur as a result of our participation in any of the activities named herein. My signature signifies that I fully understand and agree to be bound by this Release and Waiver Agreement for myself and for my minor child and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect. Further, with my signature, I consent to the use of my/our photograph to be used in marketing or social media directly related to the NAV Festival of Races.
4. I further understand that NAV is contractually obligated to provide the Worldloppet Ski Federation (hereinafter, “WSF”) with demographic data for each Vasa race participant, to include the participant’s name, gender, date of birth, citizenship and race results. I hereby consent to WSF publishing my/our personal data, as described above on the Global Ski Calendar and the WSF webpage: https://www.worldloppet.com/global-ski-marathon-calendar/.
5, I hereby grant and authorize NAV to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all photographs and videos taken of me by NAV without compensation. The authorizations shall continue indefinitely, unless I revoke said authorization in writing. I understand and agree that these materials shall become the property of NAV and will not be returned.
